The Supreme Court ruled that a person appointed on an ad hoc basis cannot claim a lien on the post, as established under the Railway Establishment Code, specifically Rules 157 and 328. The Court found Rule 328(2), which invalidated promotions granted to employees from August 1, 1961, to March 11, 1973, to be arbitrary and void, thereby upholding the promotions of the appellants. Consequently, the Court reinstated the appellants' promotions and declared that the General Manager lacked authority to issue the circular affecting their seniority.
