The Supreme Court held that under Section 13(1)(f) of the Rajasthan Premises (Control of Rent and Eviction) Act, 1950, a tenant's denial of the landlord's title must be clear and unequivocal for eviction to be justified. The Court found that the appellant's earlier suit did not constitute a clear denial of the respondent's title, as it did not seek relief against the landlord and described the appellant's possession as that of a tenant. Consequently, the Court allowed the appeal, reversing the eviction decree.
