Judgment text excerpt

The Supreme Court held that the property allotted to the appellant-society was merely a 'plot' of land with a self-constructed shed and did not qualify as 'premises' under Section 2(i) of the Delhi Rent Control Act, 1958. The Court affirmed the concurrent findings of fact by lower courts that the society was not a tenant of any premises as defined by the Act, thus making the eviction suit maintainable in civil court. The appeal was dismissed, upholding the lower courts' decisions.
