The Supreme Court held that under Section 21(1)(j) of the Karnataka Rent Control Act, 1961, the appellant tenant is entitled to occupy a shop in the reconstructed building that corresponds to the original tenement. The Court affirmed that the eviction decree was valid and not merely by consent, and that the landlord must provide the tenant with a reasonably comparable shop as per Sections 27 and 28 of the Act. The appeal was allowed, granting the appellant possession of the shop occupied by Respondent No. 2.
