The Supreme Court held that under the U.P. Secondary Educational Laws (Amendment) Act, 1976, prior approval from the District Inspector of Schools is mandatory before taking action against teaching staff, including suspension. The Court ruled that the respondent's suspension was illegal due to non-compliance with this requirement, and thus, the order of suspension ceased to be operative from 17.10.1975. The Court also awarded the respondent Rs. 10,000 for salary arrears from 20.2.1964 to 15.1.1966, reversing the lower court's dismissal of his claim for salary.
