The Supreme Court held that under Section 13(1)(a) and Section 14 of the West Bengal Premises Tenancy Act, 1956, a tenant cannot sub-let premises without the landlord's written consent. The appeal was allowed, overturning the High Court's decision that the suit was barred by res judicata, as new sub-tenancies were created after the earlier suit, which were not addressed in that judgment.
