The Supreme Court held that under Section 39 of the U.P. Urban Building (Regulation of Letting, Rent and Eviction) Act, 1972, tenants must deposit arrears of rent within one month of knowledge of the suit. The Court found that the respondents were entitled to the benefit of Section 39 as they deposited the arrears after learning the correct date of construction of the shop, which was not disclosed by the appellant. The Court upheld the High Court's decision that the respondents were not at fault for the timing of their deposit and thus allowed their claim under Section 39.
