The Supreme Court held that the amendment to the Andhra Pradesh Panchayat Raj Engineering Service (Special) Rules, 1963, made on April 28, 1980, is not applicable to vacancies that arose prior to that date. The Court clarified that the amendment, which stipulated that '37-1/2 per cent of the substantive vacancies' shall be filled by direct recruitment, only pertains to vacancies arising after the amendment. The Court set aside the Tribunal's judgment, affirming that the State Government could fill vacancies based on the pre-amendment rules.
