The Supreme Court held that under Sections 39 and 40 of the Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972, a tenant must deposit taxable costs to be absolved from eviction liability. The Court clarified that non-deposit of such costs does not automatically disqualify the tenant from the benefits of these sections, as the landlord can only claim taxable costs. The appeal was allowed, granting the tenant relief from eviction due to compliance with the deposit requirements of the Act.
