The Supreme Court held that Rule 158 of the Indian Railway Establishment Code allows General Managers to make rules for non-gazetted railway servants, provided they align with the Railway Board's regulations. The Court found that the Railway Board's circulars from 1963 and 1984 did not violate Article 14 of the Constitution, as they did not create hostile discrimination against the Kharagpur PCO employees compared to those at the Integral Coach Factory. The petitioners' claims of vested rights were dismissed, as no such rights were established under the inconsistent memorandum issued in 1973.
