The Supreme Court held that the termination order of the respondent was issued without jurisdiction as it was not passed by the Governing Body of the College, which alone had the authority to terminate a teacher's services. The Court found that both parties misrepresented the facts regarding the Principal's role in the termination. The High Court's assumption that the termination was by an authority other than the appointing authority was unsupported by evidence.
