Judgment text excerpt

The Supreme Court held that under Section 169(1) of the U.P. Zamindari Abolition & Land Reforms Act, 1951, a Bhumidhar can bequeath a life estate to his wife while retaining the remainder for his daughters. The court clarified that the wife's interest remains a life estate and does not enlarge to defeat the bequest to the daughters. The appeal was dismissed, affirming the daughters' rights as Bhumidhars.
