The Supreme Court held that the Municipal Corporation of Greater Bombay's Resolution No. 567 dated 12.9.1975, which provided for reservation of posts for backward classes, was applicable only prospectively and could not disturb promotions made prior to its enactment. The Court clarified that service conditions cannot be modified retrospectively to deprive employees of their vested rights without a valid law. Consequently, the first respondent was deemed to have been promoted from 12.9.1975, not from the earlier date of 23.5.1974 as directed by the High Court.
