The Supreme Court held that a revision application is maintainable under Section 115 of the Code of Civil Procedure, 1908, in conjunction with Section 50(1) of the Karnataka Rent Control Act, 1961, even when a District Judge has made an order in his revisional jurisdiction under Section 50(2) of the Act. The Court overruled the contrary view taken in M.M. Yaragatti v. Vasant, ILR 1987 Kar. 1286, and approved the Full Bench decision in Krishnaji Venkatesh Shirodkar v. Gurupad Shivaram Kavalekar & Ors., ILR 1978 Kar. 1585. The ruling clarifies the jurisdictional scope of the High Court in revising orders made by District Judges under the Act.
