The Supreme Court upheld the High Court's decision that the U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972, does not apply to the tenants as the exemption period of ten years from the date of first assessment for house-tax (October 1, 1976) had not expired. The Court clarified that since the eviction suit was filed after the Act's enforcement and the tenants did not have pending suits on July 15, 1972, they were not entitled to the Act's protections. The decree for eviction was affirmed but execution was stayed until March 31, 1988, subject to the tenants' undertaking.
