The Supreme Court held that under the U.P. Industrial Development Act, 1976, the refusal of the New Okhla Industrial Development Authority to grant permission for the development of land owned by a Cooperative House Building Society was valid. The Court found that the Government Order dated 9.4.1980, which suggested that lands of such societies should not be acquired, was merely directory and did not impose a mandatory obligation on the Authority. The Court upheld the High Court's dismissal of the writ petition, affirming the Authority's discretion in land acquisition under the Land Acquisition Act, 1894.
