Judgment text excerpt

The Supreme Court held that under Section 14 of the Hindu Succession Act, 1956, a female Hindu can transfer her property by will once her limited estate becomes absolute. In this case, the widow had only a life interest in the properties until 1956, but after the Act came into force, her estate became absolute, allowing her to bequeath the properties. The Court found the will executed by the widow to be valid and upheld the appellants' claim as legatees under the will, reversing the lower court's decision that declared the earlier gift deed ineffective against reversionary rights.
