The Supreme Court upheld the detention order under Section 3 of the Prevention of Blackmarketing and Maintenance of Supplies of Essential Commodities Act, 1980, affirming that the detenu's actions of diverting levy cement for private use were prejudicial to essential supplies. The Court ruled that delay in passing the detention order does not vitiate it, and the propriety of the grounds for detention cannot be scrutinized by the Court. It was also held that the detenu has no right to have successive representations based on the same grounds formally disposed of again.
