Judgment text excerpt
The Supreme Court held that under Section 11(3) of the Kerala Buildings (Lease and Rent Control) Act, 1965, a landlord can seek eviction if he bona fide needs the premises for his own occupation, even if the tenant is using it for non-residential purposes. The Court clarified that Section 17 does not apply to the landlord's need for residential use, as it pertains to tenant-initiated conversions. The concurrent findings of the lower courts on the landlord's bona fide need were upheld, and the appeal for eviction was dismissed.
