The Supreme Court held that the Urban Land (Ceiling and Regulation) Act, 1976 applies to lands subject to acquisition under the Land Acquisition Act, 1894. The Court found the High Court's ruling that the lands were not 'vacant land' under the Urban Land Act due to the Bombay Town Planning Act, 1954, to be unsustainable. The Court clarified that the owners could construct buildings on the lands with local authority permission, thus affirming the applicability of the Urban Land Act to the lands in question and allowing the State's appeal.
