The Supreme Court upheld the Full Bench's decision regarding the Punjab Security of Land Tenure Act, 1930, stating that the entire holding of a person as of April 15, 1953, must be considered for determining surplus area. The Court clarified that the government has an indefeasible right to utilize surplus land for tenant resettlement without a time limit, and the owner cannot reclaim unused surplus land. Additionally, the Court ruled that landowners cannot claim separate allotments in both Punjab and Haryana under Section 88 of the Punjab Reorganisation Act, 1966, as the provisions of the old Act continue to apply to the new State.
