The Supreme Court examined the applicability of the Civil Services (Classification, Control and Appeal) Rules, 1930, in relation to the appellant's right to appeal against disciplinary action. The Court held that Article 235 of the Constitution preserves the right of appeal for judicial service members under the relevant service rules. The Court concluded that the appellant, being an Additional Subordinate Judge, is entitled to appeal to the Governor against the order of punishment imposed by the High Court, thereby allowing the appeal.
