The Supreme Court held that under Section 3(e) of the U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972, a Prescribed Authority must be a Magistrate of the First Class with three years' experience. The Court affirmed the findings of the Prescribed Authority and the Appellate Authority that the respondents' need for possession was bona fide and that the comparative hardship favored them. The High Court's dismissal of the jurisdictional challenge was upheld, as the issue involved disputed facts beyond the scope of Article 226 proceedings.
