Judgment text excerpt

The Supreme Court held that the Chief Settlement Commissioner was competent under Section 24 of the Displaced Persons (Compensation and Rehabilitation) Act, 1954 to cancel the allotment of excess land to the appellant, as the land had vested in the Punjab Government under the package deal. The Court affirmed that the Managing Officer's order allowing the sale of excess land was without jurisdiction since the property was no longer part of the Central Government's compensation pool. The appeal was dismissed, upholding the High Court's decision that the transfer to the appellant was void ab initio.
