The Supreme Court ruled that under the U.P. Cantonment Rent Control Act, 1952, a landlord may file for tenant eviction without District Magistrate's permission if the tenant has made unauthorized constructions that materially alter the accommodation. The Court established that three cumulative conditions must be met: (1) the tenant made constructions, (2) without the landlord's consent, and (3) these constructions materially altered the accommodation. The Court clarified that 'materially altered' refers to substantial changes affecting the building's character and structure, and minor alterations for convenience do not qualify as material alterations.
