The Supreme Court held that refugees from West Pakistan, domiciled in Jammu and Kashmir for nearly forty years, do not qualify as permanent residents under Section 6 of the Jammu and Kashmir Constitution, thus denying them rights to electoral participation, land acquisition, and employment under the State. The Court upheld the validity of disqualifications under Section 12(1)(b) of the Jammu and Kashmir Representation of the People Act, 1957, and other relevant statutes, citing Article 35A of the Constitution of India. The Court acknowledged the grievances of these refugees but stated that legislative action is required to amend existing laws to enhance their rights.
