The Court upheld the validity of disqualifications under Section 12(1)(b) of the Jammu and Kashmir Representation of the People Act, 1957, and other relevant statutes, citing Article 35A of the Constitution of India. The Court acknowledged the grievances of these refugees but stated that legislative action is required to amend existing laws to enhance their rights.
