Judgment text excerpt

The Supreme Court addressed the issue of absorption of a retired Army officer, who was initially appointed as Assistant Commandant in the Central Reserve Police Force (CRPF) and later promoted to Commandant on a temporary basis. The Court held that the amended Rule 107(2) of the Central Reserve Police Force Rules, 1955 applies to the respondent, entitling him to absorption in the cadre from the date of the amendment, but only for pension purposes. The Court set aside the High Court's direction for permanent absorption, stating that prior to the amendment, the rules indicated that such absorption was not permissible.
