The Supreme Court held that Rule 51(A) of Chapter XIV(A) of the Kerala Education Rules does not provide an absolute preferential right to a teacher who worked earlier over one who worked later in the same school. The Court emphasized that while the Note appended to the Rule does not have binding effect, it carries persuasive force in determining preference based on the date of first appointment and age. The Court allowed the appeal, stating that the management's choice among qualified teachers should consider the Note's guidance, but it does not restrict the management's discretion in appointments.
