The Supreme Court addressed the entitlement of claimants to compensation under the Requisition and Acquisition of Immovable Property Act, 1952 and the West Bengal Estates Acquisition Act, 1953. The Court held that the claimants are entitled to Rs.2,00,000 as terminal compensation and Rs.25,650 as recurring compensation from 1-10-1942 to 15-4-1955, along with 6% interest from the date of requisition. The Court clarified that the provisions of the 1953 Act do not apply to the requisitioned property, allowing the claimants to retain certain rights over the land despite its vesting in the State after 15-4-1955.
