The Supreme Court examined the applicability of Section 12 of the Delhi School Education Act, which exempts unaided minority schools from the provisions of Sections 8 to 11 concerning terms and conditions of service. The Court held that while the principle of equal pay for equal work under Section 10 is significant, Section 12 does not violate Articles 14, 21, and 23 of the Constitution, nor does it infringe upon the rights of minorities under Article 30. Consequently, the Court upheld the validity of Section 12, affirming that the conditions of service for unaided minority schools can differ from those of recognized private schools.
