The Supreme Court held that the respondents, diamond exporters, are restrained from importing dry fruits under Additional Licences granted to them during the Import Policy 1985-88. The Court clarified that under the Import Policy 1978-79, dry fruits could be imported by all persons without the need for an Additional Licence, and thus, the denial of such licences to diamond exporters did not cause them any damage. The Court concluded that the import of dry fruits was permissible for all, and the petitioners' challenge under Article 32 was upheld.
