The Supreme Court held that following the enactment of the U.P. Secondary Education Services Commission and Selection Boards Act, 1982, the provisions of Section 16-G(2)(c) of the U.P. Intermediate Education Act, 1921, which allowed for the transfer of a Principal from one Intermediate College to another, are no longer operative. The Court clarified that the appointment of a Principal must now be made only on the recommendation of the Commission as per Section 16(1)(a) of the Services Commission Act. Consequently, the appeals and special leave petition were dismissed, affirming the High Court's decision that the transfer process was invalid under the new legal framework.
