Judgment text excerpt

The Supreme Court examined the validity of Rules 6(4)(i) and 6(4)(iii)(a) of the Gujarat Judicial Service Recruitment Rules, which impose an age restriction of 48 years for promotion to the post of Assistant Judge. The Court held that such age restrictions are arbitrary and discriminatory, violating Articles 14 and 16 of the Constitution, as they unjustly limit the eligibility of qualified candidates based solely on age. Consequently, the Court set aside the High Court's dismissal of the writ petition and declared the age restriction ultra vires.
