Judgment text excerpt

The Supreme Court addressed the maintainability of intra-court appeals under Clause 15 of the Letters Patent in light of Articles 226 and 227 of the Constitution. It held that no intra-court appeal lies against a judgment of a Single Judge in a petition under these Articles, as established by the Full Bench in Shankar Naroba Salunke v. Gyanchand Lobhachand Kothari. The Court clarified that Clause 15 ceased to operate with the commencement of the Constitution, which conferred new powers to the High Courts, thus affirming the dismissal of the appeal as incompetent.
