Judgment text excerpt

The Supreme Court upheld the High Court's decision that there cannot be different pay scales for Workshop Instructors based solely on their educational qualifications (Diploma vs. Certificate) as it violates Article 14 of the Constitution. The Court found no evidence that a Diploma is a higher qualification than a Certificate, and noted that both were eligible for the same pay scale at the time of recruitment. Consequently, the appeal by the State was dismissed, affirming that the respondent should be placed in the same pay scale as Diploma holders.
