The Supreme Court held that under Section 25 of the Code of Civil Procedure, it has the power to transfer a suit from one State to another when the ends of justice demand it. The Court emphasized that justice must not only be done but must also be seen to be done, especially in sensitive cases where strong community feelings may arise. Given the extraordinary circumstances in Punjab at the time, the Court found it necessary to transfer the suit claiming damages of Rs. 1000 crores for loss to Gurdwara properties to ensure a fair trial in a calmer environment.
