The Supreme Court held that under Section 57 of the Motor Vehicles Act, 1939, an application for variation of an existing permit involving extension of route must be made to the Regional Transport Authority (RTA) that granted the permit, even if the extension lies entirely within another RTA's jurisdiction. The Court clarified that Section 45 does not apply to variations of permits. The High Court's decision to quash the Tribunal's order was overturned, allowing the appeal and affirming the Tribunal's authority to grant the variation.
