The Supreme Court held that the action of the Reserve Bank of India in striking off the name of the appellant, a tikka mazdoor, from the rolls constituted retrenchment under Section 2(oo) of the Industrial Disputes Act, 1947. The Court found that the Tribunal erred in dismissing the claim based on the absence of a representative trade union and that the appellant's continuous employment for 240 days was sufficient to invoke Section 2A of the Act. The Court allowed the appeal, reinstating the appellant's claim for unfair labor practice and retrenchment.
