The Supreme Court held that under the Uttar Pradesh Urban Buildings (Regulation of Letting, Rent and Eviction) Amendment Act, 1976, the District Magistrate must provide an opportunity to landlords and tenants before making an allotment order under Section 16(1). However, the amendment does not require the same for tenants when releasing premises to landlords. The Court directed the High Court to rehear the writ petitions on merits, emphasizing the need for procedural fairness in allotment and release processes under Sections 16 and 18 of the Act.
