Judgment text excerpt

The Supreme Court dismissed the appeal regarding the grant of stage carriage permits under Section 57(2) of the Motor Vehicles Act, 1939. The Court held that the absence of a fresh Notification by the properly constituted Regional Transport Authority (RTA) was immaterial since applications could be filed voluntarily without such Notification. The Court further clarified that the appellant, having applied under the earlier Notification, could not challenge the lack of a new Notification, and the decisions made by both the RTA and the Appellate Authority were valid and properly constituted.
