The Supreme Court held that under Section 43 of the Transfer of Property Act, a vendor who makes a representation regarding ownership cannot later deny that representation if the vendee acts on it. In this case, the vendor deposited the required amount under Section 134 of the U.P. Zamindari Abolition and Land Reforms Act on October 28, 1961, and executed a sale deed on the same day, despite not yet having Bhumidari rights. The Court reversed the High Court's decision, affirming that the sale was valid as the vendee acted on the vendor's representation, thus entitling him to protection under Section 43 of the Transfer of Property Act.
