The Supreme Court held that the appellants, who were promoted as officiating Sub-Inspectors of Police, are entitled to have their continuous officiating service counted for seniority as Sub-Inspectors. The Court clarified that in the absence of specific rules, seniority between direct recruits and promotees should be based on continuous officiation in non-fortuitous vacancies. The High Court's ruling that seniority could only be reckoned from the date of confirmation was overturned, and a writ was issued to re-fix the seniority of the appellants accordingly.
