The Supreme Court held that Section 433A of the Code of Criminal Procedure, 1973 does not bar the release of an adolescent offender transferred to a Borstal School under Section 10-A of the Andhra Borstal Schools Act, 1925 after he attains the age of 23 years. The Court clarified that once an offender is sent to a Borstal school, he ceases to be a prisoner undergoing imprisonment, thus the provisions of Section 8 of the Act must be fully applied. The appeal by the State Government was dismissed, affirming the High Court's order for release.
