The Supreme Court ruled that the right to receive pension is a fundamental right under Article 19(1)(f) and cannot be curtailed by subsequent executive orders, as established in Deokinandan Prasad v. State of Bihar. The Court held that the appellant, a retired employee of the erstwhile Hyderabad State, was entitled to a pension of Rs. 1,000 per month, which had accrued at the time of retirement and could not be altered by a retrospective amendment to the Hyderabad Civil Service Regulations. The appellant was granted future pension payments and arrears for three years prior to the writ petition.
