SMT. J.S. RUKMANI ETC. vs GOVERNMENT OF TAMIL NADU AND ORS.

The Supreme Court ruled that the State of Tamil Nadu is liable to pay family pension to the widows of government servants who retired before 1st April 1964, as per the Notification dated 26th May 1979. The Court held that the exclusion of widows based on the last place of service being outside Tamil Nadu is unconstitutional and void under Section 86 of the States Reorganisation Act, 1956. The Court directed the State to pay arrears of family pension at the rate of Rs. 100 per month from 1st April 1979.
