Judgment text excerpt

The Supreme Court held that any appeal on the grounds of religion, race, caste, community, or language constitutes a corrupt practice under Section 123(3) of the Representation of the People Act, 1951. The Court found that the allegations against the respondent regarding the influence of the Akal Takht and the issuance of Hukamnama during elections were substantiated, thus violating the provisions of the Act. The election of respondent No. 3 to the Punjab Legislative Assembly was declared void due to these corrupt practices.
