The Supreme Court upheld the scheme framed by the office of the Accountant General, West Bengal, under office order No. TM 96 dated June 8, 1966, which allowed Upper Division Clerks who had served for 20 years and were over 45 years of age to be promoted without passing the Subordinate Accounts Service Examination. The Court found that this scheme did not violate Articles 14 and 16 of the Constitution as it created a reasonable classification based on service duration and age, distinguishing those eligible for promotion from others still able to take the examination. The appeal against the High Court's decision was dismissed, affirming the validity of the scheme.
