The Supreme Court held that under Sections 179 and 180 of the Code of Criminal Procedure, the court where sub-standard fertilizer was marketed has jurisdiction to try the manufacturer, even if the manufacturing occurs in a different jurisdiction. The Court clarified that both manufacturing and marketing of sub-standard fertilizer are distinct offenses but are interconnected, allowing for trial in the jurisdiction where the consequences of the offense occurred. The appeal by the State was allowed, reversing the High Court's decision that had discharged the manufacturer.
