Judgment text excerpt

The Supreme Court held that the appellant, a security inspector, qualifies as a 'workman' under Section 2(s) of the Industrial Disputes Act, 1947, as his duties were not managerial or supervisory. The Court found the dismissal of the appellant by the management to be disproportionate and based on a perverse inquiry, thus entitling him to reinstatement with back wages. The reference of the dispute under Section 10(i)(c) was deemed valid, and the Labour Court's decision was upheld.
