The Supreme Court held that a degree is not a prerequisite for promotion from Class II to Class I service under the Punjab Service of Engineers, Class I, P.W.D. (Buildings and Roads Branch) Rules, 1960. The Court overruled the previous decision in O.P. Bhatia & Anr. v. State of Haryana, ILR[1980]1 Punjab & Haryana 470, clarifying that the relaxation of degree requirements by the Haryana Government was invalid as it contradicted the existing rules. The Court emphasized that the government has the authority to set educational qualifications for promotions but the current rules do not prohibit promotions for those without degrees if they meet other criteria.
